Volebná kaucia: ústavnoprávna revízia po dvadsiatich rokoch. Electoral deposit: the revision from a constitutional law perspective after twenty years. Doc. JUDr. Marek Domin, PhD., Právnická fakulta UK v Bratislave Právny obzor, 109, 2026, No. 2, pp. 93 – 109. Published online: 2026 https://doi.org/10.31577/pravnyobzor.2026.2.01 Abstract. The subject of the article is electoral deposit in relation to elections to the National Council of the Slovak Republic. This institute has been out of the spotlight of Slovak constitutional law scholars for the past few years. However, it came to light again in 2025, when the Minister of the Interior presented proposals for fundamental changes to legal regulation of electoral deposit. The article not only describes the essence of electoral deposit, but also historical context of its introduction into legal order of the Slovak Republic, as well as the position of the Constitutional Court of the Slovak Republic towards it and practical impacts of that institute. Against the background of the proposed changes, the article provides, also based on a brief international comparison, an analysis of the constitutionality of electoral deposit and arguments in favor of its possible deletion from Slovak legal order, or at least its alternation with another institute that would not be in such significant tension with the constitutional principle of free competition of political forces. Key words: elections, electoral deposit, Constitution of the Slovak Republic, free competition of political forces, passive suffrage
