The aim of this article is to initiate a debate on the potential constitutional limits concerning the economic aspects of constitutional law in Slovakia. The first section analyzes the so-called economic dimensions of constitutional norms in Slovakia, with particular focus on the Constitutional Act on Budgetary Responsibility and Article 55a, which significantly expanded constitutional provisions. The second section examines recent case law of the German Constitutional Court, specifically its recognition of “intergenerational responsibility” and the “enhanced version of proportionality test” as established in the Klimaschutz and Debt brake decision. The third section explores relevant case law of the Slovak Constitutional Court, particularly its rulings on the so-called family package and the recent decision on the state budget. These decisions illustrate how the Slovak Constitutional Court interprets its role concerning the economic aspects of constitutional norms. Finally, the article advances the hypothesis that the Slovak Constitutional Court adopts a relatively restrictive approach in this regard and argues that there is room to strengthen its position in alignment with the normative text of constitutional provisions. Moreover, it highlights the German Constitutional Court’s distinct approach in the context of climate action and fiscal constraints and considers its potential applicability to Slovak constitutional law.
