Published online: 15.1.2019 Abstract. Czecho-Slovakia was under pressure of German Reich. Part of its territory was occupied by German forces even in March 14, 1939. Professor Hans Kelsen’s Memorandum from August 1939 conceived as a complaint to the forum of the League of Nations reflects this fact and to that added legal ornaments as legally entirely void. Our contribution is focused on argumentation on behalf of peaceful country (Czechoslovakia) and law versus arbitrary force of aggressor.
