Földeš , R. – Džačár , Ľ.: On the interpretation requiring a breakdown of instalments of a consumer credit.

Právny obzor, 101, 2018, č. 3, s. 284 – 314.

Abstract. This article aims to provide a comprehensive analysis of the statutory provision requiring the amount, number and frequency of repayments of capital, interest and other charges be specified in a consumer credit agreement, particularly in view of a portion of the national judicial practice which requires that the contract must state precisely the part of each individual instalment that is to be used to repay capital and the part that is to be used to pay contractual interest and charges. The provision is inspected using standard interpretative criteria recognized by domestic law; in the final segment, the principle of proportionality is also used to test the legal consequences laid down in the legislation in question.

Key words: consumer credit agreement, mandatory information to be included in consumer credit agreement, interpretation, principle of proportionality
