Life may model certain situations that the legal norm does not foresee and does not precisely address. Therefore, it is necessary to address the legal issue raised by the basic methods of interpretation so that the provisions relating to the execution lien do not become mere letters on the pages of the execution title but can also be correctly applied. In the present paper, the authors interpret the relevant provisions of the Enforcement Code as well as the Civil Code, in correlation with answering the preliminary questions determining the conclusions of the primary judgment. The authors seek an answer to the question whether an enforcement officer is entitled to conduct a enforcement by sale of real estate, provided that the contractual mortgagee on the immovable property is not the same person as the beneficiary in the foreclosure. They analyze and interpret the question by means of basic methods of interpretation and consider the possibility of using analogy. In this context, they also consider the impact of the amendments to the Execution Code on the issue under examination.
