Abstract. The present article deals with the issue of drunkenness, a specific
crime with an emphasis on „actio libera in causa“ in the intentional and
negligent form, which is currently in a society little discussed and with a
legal practice ignored. The low number of crimes of drunkenness is reflected in
the relatively weak case of law courts, particularly in the context of this
institute. In this paper I point out the deficiencies in particular the
complexity of the offense of drunkenness. Then we mention considerations de lege
ferenda in terms of increased efficiency of legislation.
