Consumer commerce – fifth type of commercial obligation relations as consumer protection in commercial relations. The article addresses the issue of assessment of commercial obligation relations after the adoption of amended Act No. 102/2014 Coll., amending Section 52 (2) of the Civil Code. Section 52 (2) of the Civil Code, as amended by Act No. 102/2014 Coll., significantly changes the view of absolute commerce and facultative commerce between the consumer and the supplier. The author reflects on the interpretation of Section 52 (2) of the Civil Code, as amended by Act No. 102/2014 Coll. in conjunction with Sections 261 and 262 of the Commercial Code. The author disputes the explanatory report to the amendment, providing that norms of the Civil Code are more favourable for the consumer than norms of the Commercial Code, without any further justification.
