Legal administration of adversary in the Anglo-Saxon criminal system belongs to an ,,undoubtedly significant topic“1, discused in the ranks of professional public, together with the inherent issue of the legal regulation of elememts of adversary in the USA despite, the fact that the issue „is not terra incognita“2. In the following parts of writing, the author will thereforce reflect on the mentioned issue with an exhaustive interpretive arc in an effort to bring the common law system closer to the immanent insight into contradictions and will compare this with the domestic legal system..
