The European Court of H uman Rights and the Constitutional Court of the Slovak Republic continue to enforce the requirements of the substantive rule of law in the process of assessing the permissibility of limiting the right to information, but at the same time they also identify situations of overuse of the right to information. The Constitutional Court of the Slovak Republic opened a new decision-making practice, according to which the procedural situation of the absence of a valid decision on the merits of the applicant‘s right to access information within a certain time frame constitutes a violation of the applicant‘s substantive right to information.
